Delhi HC Rejects RCB’s Plea Against Uber’s Travis Head Ad, Cites ‘Sportsmanship’

In a significant ruling, the Delhi High Court has rejected the Royal Challengers Bangalore (RCB) franchise’s plea against Uber India’s advertisement featuring Australian cricketer Travis Head. The court dismissed the application for an interim injunction, stating that the ad, which humorously referred to the IPL, should be viewed as lighthearted and in the spirit of sportsmanship.

The RCB franchise had filed the plea, claiming that the Uber ad, which depicted a modified version of RCB’s slogan, could potentially damage its brand image. The ad, created in collaboration with Uber and Travis Head, humorously poked fun at the team and its IPL journey, leading to RCB’s concerns over its negative portrayal.

However, Justice Saurabh Banerjee, who presided over the case, ruled that the advertisement did not constitute disparagement or violate RCB’s trademark rights. The judge highlighted that the ad was a playful expression and should not be taken as an attack on the IPL franchise.

“The advertisement was made in good spirit, within the bounds of sportsmanship, and does not merit judicial interference,” the court said in its verdict.

The ruling is being seen as a victory for freedom of expression, particularly in the realm of sports advertising. Lawyers representing Uber argued that the ad was created in the context of cricket and should be regarded as part of the game’s culture, which often includes humor and playful banter between players and teams.

RCB, which has long been one of the most high-profile teams in the Indian Premier League (IPL), has not yet made a public statement regarding the decision. It remains to be seen whether the franchise will pursue further legal action in the matter.

The advertisement had sparked debates across social media platforms, with some fans supporting the lighthearted humor, while others questioned the ethics of using a team’s brand in such a manner.
